Owning property in Paraguay while living somewhere else

Property ownership, permission to stay and tax residence need separate decisions and separate evidence.

Property ownership from abroad: title, management and tax

By Ties Jezuit · Reviewed 14 October 2026 · General orientation

Start with the buyer and the specific property

Foreign ownership is generally possible, but the actual land, title, buyer and use matter. Paraguay’s frontier-security law creates restrictions for specified buyers from neighbouring countries in a fifty-kilometre border zone involving rural property. That is not a blanket ban on every foreign buyer throughout Paraguay. Have a local lawyer identify the rules applicable to your nationality, ownership structure and parcel before signing or paying a deposit.

A beautiful visit is the beginning of due diligence

Confirm the registered owner, title chain, encumbrances, cadastral identity, boundaries, access and any occupation or tenancy. Check whether roads, water, utilities and advertised buildings are legally and physically part of what is sold. A notarial transaction and independent legal advice have different roles. Do not let the same person’s enthusiasm substitute for each professional check. Property scouting can help you observe the location and prepare those questions.

Decide who looks after it while you are away

Agree maintenance, keys, emergency repairs, taxes, insurance, security and reporting. If you rent it out, review the local income and contract obligations separately. A power of attorney should have a clear scope, duration and safeguards; discuss it with your lawyer. Keep receipts, a private inventory and a reliable contact process. Distance changes the practical risk even where legal ownership is straightforward.

Check both countries’ tax questions

The country where the property sits and the country where you remain tax resident may both require reporting or a review of income and asset treatment. A Paraguayan cédula does not remove Dutch obligations by itself. Share the purchase, financing, intended use and management arrangement with both advisers. I can coordinate an exploratory brief and viewings; legal title, tax conclusions and technical inspection are separate assignments.
